1. Information We Collect
We collect the following categories of personal data:
- Account information: Email address, display name, and profile photo when you create an account
- Recording content: Screen recordings, webcam recordings, and associated metadata (duration, file size, timestamps)
- Audio transcriptions: When you record with audio, your recorded speech is processed by OpenAI's Whisper API to generate text transcripts with word-level timestamps
- Billing information: Payment details are collected and processed directly by Stripe. We store your Stripe customer ID and subscription status but never your card details
- Usage data: Recording view counts, feature usage, and interaction data
- Technical data: Browser type, device information, and IP address for security and debugging purposes
2. How We Use Your Information
We use your information to:
- Provide, maintain, and improve the Focuscap service
- Process and store your screen recordings
- Generate text transcripts from your recorded audio using AI
- Process payments and manage subscriptions through Stripe
- Send transactional emails (account verification, password resets, security alerts) through Resend
- Detect and prevent fraud, abuse, and security incidents
- Provide customer support through our embedded chat widget (small.chat), loaded only with your consent
3. Third-Party Data Processors
We share your data with the following third-party processors to provide our service:
- OpenAI — Your recorded audio is sent to OpenAI's Whisper API for transcription. OpenAI processes the audio to generate text and does not use your data for model training under their API terms. Audio data is transmitted securely and not retained by OpenAI after processing.
- Stripe — Payment processing, billing management, and subscription handling. Stripe acts as an independent data controller for payment data.
- Amazon Web Services (AWS) — Infrastructure provider for our backend services, authentication (Cognito), and database (RDS). Data is hosted in the US-East-1 region.
- Cloudflare — CDN, web hosting (Cloudflare Pages), and object storage (R2) for recordings and static assets.
- Resend — Transactional email delivery for account verification codes, password resets, and administrative notifications.
- small.chat — Customer support chat widget, loaded only after you accept cookies.
4. Cookies & Consent
We use essential cookies for authentication and session management. Third-party scripts (such as our support chat widget) are only loaded after you explicitly accept cookies. You can decline cookies and still use all core features of Focuscap.
5. Shared Content & Recording Privacy
When you create a recording, it is public by default — anyone with the shareable link can view it. You can change a recording to private at any time from the recording page, which restricts access to only you (the owner).
Public recordings are accessible via their unique URL. We do not index or list public recordings — they are only accessible to people who have the link. However, once shared, you cannot control who the recipient shares it with.
6. Data Security
We implement appropriate technical and organizational measures to protect your personal data, including:
- Encryption in transit (TLS/HTTPS for all connections)
- Encryption at rest for sensitive tokens and credentials
- Secure authentication via AWS Cognito with PKCE
- Parameterized database queries to prevent injection attacks
- CORS origin restrictions to prevent unauthorized API access
- Security headers (CSP, HSTS, X-Frame-Options) on all web pages
7. GDPR Compliance
If you are located in the European Economic Area (EEA), you have certain data protection rights under the General Data Protection Regulation (GDPR).
Legal Basis for Processing
We process your personal data based on:
- Consent — when you accept cookies for third-party scripts
- Contract performance — when providing our recording and subscription services
- Legitimate interest — for security monitoring, fraud prevention, and service improvement
Data Retention
We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected. When you delete your account, your data is scheduled for permanent deletion within 24 hours. During this grace period, your account remains recoverable. After 24 hours, all your recordings, transcripts, avatars, subscription data, authentication records, and profile information are permanently and irreversibly removed from all our systems, including third-party services (Cognito, Stripe).

Focuscap is a product of Untitled Product, LLC, which acts as the data controller for your personal information.
8. Your Rights
Under GDPR and applicable data protection laws, you have the right to:
- Access — Request a copy of your personal data (use "Export My Data" in Settings)
- Rectification — Update your profile information in Settings
- Erasure — Delete your account and all associated data (use "Delete Account" in Settings)
- Portability — Export your data in JSON format with download links for recordings
- Restriction — Request restriction of processing your data
- Objection — Object to processing based on legitimate interests
- Withdraw Consent — Withdraw cookie consent at any time by clearing your browser data

9. International Data Transfers
Your data is processed and stored in the United States (AWS US-East-1 region and Cloudflare's global network). If you are located outside the US, your data will be transferred internationally. We ensure appropriate safeguards are in place, including Standard Contractual Clauses where required.
10. Children's Privacy
Our service is not directed to children under 16. We do not knowingly collect personal data from children. If you believe we have collected data from a child, please contact us immediately.
Terms of Service
1. Acceptance of Terms
By accessing or using Focuscap, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.
2. Description of Service
Focuscap is a screen recording and sharing platform that allows users to capture, store, and share video recordings. The service includes features such as screen recording, webcam recording, AI-powered transcription, and shareable video links.
3. Subscription Terms
Focuscap offers tiered subscription plans (Premium at $8/month, Advanced at $16/month) with annual billing discounts. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
- You may cancel your subscription at any time through your account settings or Stripe billing portal
- Upon cancellation, you retain access until the end of your current billing period
- Free tier users are limited to 10 recordings and 5-minute duration per video
- Refunds are handled on a case-by-case basis
4. User Conduct
You agree not to use Focuscap to:
- Record or share content that is illegal, harmful, or violates others' rights
- Distribute malware, spam, or engage in phishing activities
- Attempt to gain unauthorized access to our systems
- Use the service for any purpose that violates applicable laws
- Record content without appropriate consent from all parties
5. Intellectual Property
You retain ownership of all recordings you create using Focuscap. By using our service, you grant us a limited license to store and transmit your content solely for the purpose of providing the service. We do not claim ownership of your content.
6. Limitation of Liability
To the maximum extent permitted by law, Untitled Product, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.
7. Disclaimer of Warranties
Focuscap is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
9. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the updated terms on this page. Your continued use of the service after such modifications constitutes your acceptance of the updated terms.
